Peter Nyombi Vs Law Society: Case Flops at High Court – URN

The matter had been scheduled for its first hearing this morning before Kampala High Court Judge Stephen Musota.It however flopped after court heard that ULS had not yet filed its response although the mandatory 56 days in which they are supposed to do so were running out.Lawyer Joseph Masiko who represented Peter Nyombi in court wondered why the lawyers’ body had not filed its response and yet they had served it with summons on September 24. But in response, lawyer Mohammed Mbabazi who represented the Law Society, asked court for more time to enable him file the response.Mbabazi told court that he only received instructions from the law society on Friday, November 1st, to represent them hence the delay.After listening to both sides, the presiding judge ordered Uganda Law Society to file its response by Friday, November 8th before fixing December 9 as the date for hearing of the matter at hand.
This matter arose on August 29 following an extra-ordinary meeting of the society in which its members unanimously resolved to suspend Peter Nyombi from their professional body by issuing him with a certificate of incompetence.Among other reasons for his suspension were that he misadvised President Museveni on a number of controversial issues including the re-appointment of Benjamin Odoki as Chief Justice and the appointment of Gen Aronda Nyakairima, a serving army officer, as Minister of Internal Affairs.The lawyers at the meeting also expressed extreme displeasure with Nyombi before disassociating themselves from his conduct and opinions for allegedly being inconsistent with the Constitution.
But being aggrieved by the lawyers’ decision, Nyombi decided to sue over the same. He argues that he was condemned by the ULS unheard; a move he said is contrary to the rules of natural justice.
He also faults the law society for not having any powers to suspend him and that their resolutions are null and void. He further claims that the ULS did not give him any reasons as to why his legal opinions were wrong.
Nyombi states that the cases cited by the ULS as a basis for his suspension are still before the Constitutional Court for determination.
Nyombi, who is also a member of the ULS by virtue of section 4 of the ULS Act, justifies his legal opinions to President Museveni as being correct on grounds that the government in a statement instead cherished them for being well researched.

Parliament on Thursday put to task the Attorney General, Peter Nyombi, to explain the sh12.9b award to city lawyer Severino Twinobusingye by the Constitutional Court.

Attorney General Peter Nyombi has petitioned the High Court in Kampala seeking its orders among others quashing his two-year suspension for allegedly being incompetent.
The Uganda Law Society (ULS) on August 29 suspended Nyombi from their professional body. In an extra-ordinary general meeting held at Imperial Royale Hotel in Kampala, the lawyers unanimously resolved to issue Nyombi with a certificate of incompetence following a series of controversial legal opinions that he gave to the President and other stake holders.
But now the Attorney General argues that a declaration that the purported resolutions of membership reached at the ULS extra ordinary general meeting is illegal, ultra vires and void.
He also wants court to compel the lawyers’ body to run a public apology published under wide circulation for a period of three weeks in both print and broadcast media.
Among other reasons, ULS suspended Nyombi for having misadvised President Museveni on a number of issues including the re-appointing Benjamin Odoki as Chief Justice after retirement and the appointment of Gen Aronda Nyakairima to a ministerial post and yet he was still a serving army officer.
As a result, the lawyers resolved to issue Nyombi with a certificate of incompetence. They also expressed extreme displeasure with the AG before disassociating themselves from his conduct and opinions for being inconsistent with the constitution
But in his complaint that he filed before court on September 20, Nyombi argues that he was condemned by the ULS unheard; a move he says is contrary to the rules of natural justice.
Through his lawyers of Kampala Associated Advocates, he also faults the Law Society for not having any powers to suspend him and that their resolutions are null and void.
Nyombi who is also a member of the ULS by virtue of section 4 of the ULS Act, justifies his legal opinions as being correct on grounds that the government in a statement instead cherished them for being well researched.

Court is yet to summon the ULS to file in its defense before a hearing date can be fixed.

Govt files appeal in sh13b oil case
The Government has appealed against the taxation award of sh12.9b in an oil case to city lawyer Severino Twinobusingye, the Attorney General, Peter Nyombi, has revealed.
“A lot has been said about this case, but above all, an appeal has been made. I advised Parliament and my advice was ignored. The man went to court and he was awarded this money,” said Nyombi.
He said he had asked court to avail him a certified copy of the taxation proceedings in the matter for purposes of preparing and pursuing the appeal.
Early this year, the Constitutional Court awarded Twinobusingye, a supporter of Prime Minister Amama Mbabazi, sh12.9b as legal costs. However, the ward has since caused public outcry.
The award was in connection to a case in which Twinobusingye sued the Government challenging Parliament’s resolution to ask Mbabazi and two other Cabinet ministers to step aside as they investigated them over bribery allegations in the oil sector.

Twinobusingye, says the money awarded to him is “peanuts” and scoffs at the job of RDC, which he was offered in Kabale, as for ‘grassing’ individuals.

Court lifts ban on Parliament oil probe
The Court had stopped the ad-hoc committee from investigating Prime Minister Amama Mbabazi and two Cabinet ministers pending a final determination of the petition filed by Severino Twinobusingye who contended that parliament has no power to set up such a committee.

The four expelled NRM rebel MPs have queried the competence of a three-member panel of the Constitutional Court, contending that its current composition of only three justices, incapacitates it to hear Constitutional cases.
The query was raised when the MPs legal team led by George Kanyeihamba, made a preliminary objection(P.O), as the Constitutional Court in Kampala convened for hearing of an application to temporarily evict the MPs before the main case is heard.

Uganda: Govt Opposes Sh13 Billion Reward for Mbabazi Supporter – allafrica.com

Government has rejected the sh12.9b costs awarded to a city lawyer who blocked Parliament from forcing Prime Minister Amama Mbabazi and two other ministers from stepping down in the oil bribery saga.
“I find the costs astronomical. My office finds the costs unjustified. We are appealing that ridiculous decision. Nowhere in Ugandan or in East Africa have such costs been awarded,” Freddie Ruhindi, deputy attorney general stressed.
